Agricultural Scope & Field Exclusions

What this site provides and what it does not:

  • What this site provides: Information, dispatch contact facilities, quote calculators, and seasonal estimates for custom farm hand labor ($12.78–$16.82/hr), piece-rate produce harvesting ($0.50–$1.00/basket), square wheat straw bales ($6.00/bale), and custom tractor tillage or precision drone spraying in Camden County and eastern North Carolina.
  • What this site does not provide: No online sales or instant checkout; no consumer retail goods; no payment processing; no off-shore labor visa brokerages; and no binding commitments without an on-site field agreement.
SEC. 04

Non-Binding Inquiries & Order Formation

That nothing is sold or paid for on the site, that a figure shown is an estimate and not a binding quote, and how an inquiry becomes an order:

Nothing is sold or paid for on this site: no account, no password, no payment and no card data. The forms and calculators on kafarms.us operate strictly for initial enquiries. Any figure shown on this website is an estimate and not a binding quote.

An inquiry becomes an enforceable order only after our South Mills farm management team reviews field parcel conditions or straw availability, both parties agree in writing to specific shift requirements or bale counts, and a separate formal agricultural work contract is executed off-site.

SEC. 05

Pricing Basis, Currency & Rate Adjustments

The basis on which anything is priced, in what currency, and what changes a price:

All figures and quotes are priced in United States Dollars (USD). Baseline pricing is structured as follows:

Service or Commodity Pricing Basis Unit in USD
Custom Field Labor Hourly farm hand crew $12.78–$16.82 USD per hour
Piece-Rate Harvest Volume harvested $0.50–$1.00 USD per 5/8 bushel basket
Square Wheat Straw Bales Per bale FOB barn floor $6.00 USD per bale

What changes a price: Actual binding prices may vary based on acreage size, ground saturation and soil conditions, field layout and canal ditching, crop fragility and handling requirements, seasonal labor availability, and whether straw bales are collected at our South Mills barn floor or transported via delivery trailer.

This website and all information, calculators, and rate indications are provided strictly on an "as is" and "as available" basis. SEC. 09

Commodity Warranty, Delivery & Inspection Conditions

This section establishes the specific warranty and quality conditions applicable to manual produce harvesting and wheat straw commodities provided by K & A Farms, Inc.:

Small Square Wheat Straw Bale Standards

Every small square bale sold from 204 Old Swamp Road is warranted to be clean, double-twine tied, dry golden wheat straw measuring approximately 14x18x36 inches with an average weight of 35 to 40 pounds. Bales are baled under controlled moisture conditions (tested below 16% core moisture) and stacked in dry timber barn storage to prevent mold, rot, and combustion.

On-Site Inspection & Claims Window

For barn-floor pick-up orders, purchaser inspection occurs on the barn floor at 204 Old Swamp Road prior to trailer departure. Once loaded and driven from the yard, straw exposure to rain, open transit spray, or improper storage becomes the purchaser’s sole risk. For farm deliveries, any dispute regarding twine breakage or transit moisture must be recorded on the delivery bill of lading within 24 hours of drop-off.

Field Labor Produce Quality Control

Our 5/8 bushel harvest picking crew operates under supervisor tallies. When hand-picking fresh market produce, field hands adhere to grower-specified color grades, stem cuts, and cull criteria. However, natural biological variation, pre-existing pest damage, and field heat prior to cooling remain the grower's operational responsibility.

SEC. 10

Limitation of Farm Operator Liability

The limit of liability:

To the maximum extent permitted by applicable law, Kafarms, its officers, employees, and crew contractors shall not be liable for any indirect, special, incidental, punitive, or consequential damages, including loss of profits, crop yield loss, or business disruption.

In all cases, the total aggregate liability of Kafarms for any claim arising out of your use of this site or from any agricultural work order shall be strictly limited to the direct fees actually paid by you to Kafarms for the specific transaction or shift giving rise to the claim, or $100.00 USD if no payment has occurred.

SEC. 11

Termination, Crew Standoff & Refusal of Service

When access can be refused or withdrawn:

Kafarms reserves the right to refuse or immediately withdraw access to this site, reject quote inquiries, or cease communications with any individual or entity that violates these terms, engages in automated scraping, attempts security breaches, submits fraudulent inquiries, or mistreats farm dispatch staff.

For agricultural services, crew access or field operations may also be terminated immediately where field safety hazards, unannounced pesticide re-entry intervals, or non-payment occur.

SEC. 12

Governing Law & North Carolina Jurisdiction

The law these terms run under and where a dispute is heard:

Governing law: the law of NC, United States, with disputes heard in the courts of SOUTH MILLS. All agreements, service estimates, website operations, and contracting transactions with Kafarms are governed exclusively by and construed in accordance with the laws of the State of North Carolina, United States.

Any legal dispute, action, or proceeding arising out of or related to these terms, this site, or our agricultural operations shall be instituted in the state or federal courts presiding over SOUTH MILLS, Camden County, North Carolina, United States.
